We are committed to protecting your privacy and handling your personal information in compliance with applicable laws, including India's Digital Personal Data Protection Act, 2023 (DPDP Act), and other applicable data protection regulations.

By using Election Clarity, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy.

For the purposes of the DPDP Act, 2023, we act as the Data Fiduciary for the personal data we collect and process through Election Clarity.

2. Information We Collect

We collect only the information necessary to provide and improve our Service. We do not collect data about voters, constituents, or members of the public who are not registered users of the App.

2.1 Information You Provide Directly

When you register and use Election Clarity as a team member (such as a candidate, campaign manager, party worker, booth agent, or volunteer), we collect:

• Account Information: Full name, email address, mobile phone number, password (stored in encrypted form)
• Profile Information: Profile photo (optional), role within the campaign team, constituency assigned
• Team & Workspace Information: Constituency selection, ward/booth assignment, team membership details
• User-Generated Content: Tasks you create or are assigned, issues you report, rally/event details, comments and notes you add within the App

2.2 Information Collected Automatically

When you use the App, we may automatically collect:

• Device Information: Device model, operating system version, unique device identifiers, app version
• Log Data: Login timestamps, IP address, actions performed within the App (such as task creation, issue updates)
• Usage Data: Features used, time spent in the App, crash reports

2.3 Permissions We Request

The App may request the following permissions on your device:

• Notifications: To alert you about task assignments, issue updates, and rally reminders
• Camera (Optional): To allow you to upload a profile photo or attach images to issues/tasks
• Photo Library (Optional): To allow you to upload images from your gallery
• Location (Optional): To help you identify your constituency or tag the location of an event/issue. Location is only collected when you actively use a location-based feature

You can grant or deny any of these permissions in your device settings, and the App will function with reduced features if certain permissions are denied.

2.4 Information We Do NOT Collect

To be explicit, Election Clarity does not collect:

• Voter data, voter rolls, or any personal information about constituents
• Contact lists or phonebook data from your device
• SMS or call logs
• Browsing history outside the App
• Biometric data
• Financial or payment information
• Health-related data

3. How We Use Your Information

We use the information we collect strictly for the following purposes:

• To create and manage your user account
• To enable team collaboration features (task assignment, issue tracking, event coordination)
• To send you in-app and push notifications relevant to your campaign work
• To authenticate users and prevent unauthorized access
• To diagnose technical issues, prevent fraud, and improve the App's performance
• To comply with applicable laws and respond to lawful requests from authorities

We do not use your information for:

• Advertising or marketing to third parties
• Selling or renting to data brokers
• Profiling for political advertising
• Any purpose unrelated to the operation of the App

4. Legal Basis for Processing (DPDP Act Compliance)

Under India's Digital Personal Data Protection Act, 2023, we process your personal data based on the following grounds:

5.1 Within Your Team

Information you provide (such as your name, role, and assigned tasks) is visible to other authorized members of your campaign team within the App. This is necessary for team collaboration.

We do not use third-party analytics, advertising, or tracking services. These service providers are contractually bound to handle your data only as required to provide their services to us.

5.3 Legal Requirements

We may disclose your information if required by law, court order, or a lawful request from a government authority, or to protect the rights, safety, and security of our users or the public.

5.4 Business Transfers

In the event of a merger, acquisition, or sale of the Company, your information may be transferred as part of that transaction. We will notify you in advance of any such change.

6. Data Retention

We retain your personal data only as long as necessary to provide the Service:

• Active Accounts: Data is retained while your account is active
• Inactive Accounts: If your account is inactive for 24 months, we may delete or anonymize associated data after notifying you
• Deleted Accounts: When you delete your account, we delete your personal data within 30 days, except where retention is required for legal, accounting, or regulatory purposes
• Backups: Residual copies in encrypted backups are deleted within 90 days

7. Your Rights

Under the DPDP Act and other applicable laws, you have the following rights:

• Right to Access: Request a copy of the personal data we hold about you
• Right to Correction: Request correction of inaccurate or incomplete data
• Right to Erasure: Request deletion of your personal data (subject to legal exceptions)

• Right to Nominate: Nominate another individual to exercise these rights in case of your death or incapacity (as provided under the DPDP Act)

8. Account Deletion

You can delete your account and associated personal data at any time by:

• Within the App: Going to Settings → Account → Delete Account
• By Email: Sending a deletion request to info@frescowebservices.com from your registered email

Upon deletion, your personal data will be removed from our active systems within 30 days. Some data may be retained in encrypted backups for up to 90 days, after which it is permanently deleted. Certain data may be retained where required by law (e.g., tax records, legal compliance).

9. International Users and Data Transfers

The App is primarily designed for users in India. If you access the App from outside India, you understand that your information may be processed and stored in India in accordance with this Policy and applicable Indian law.

10. Sensitive Context: Political Campaign Use

Because Election Clarity is used in the context of political campaigns, we recognize the sensitive nature of related data. We confirm that:

• We do not share data with political parties, candidates, or external organizations beyond your registered team
• We do not profile users based on political views
• We do not use your data for political advertising or voter targeting
• Your activity within the App is visible only to authorized members of your own team

Election Clarity is an independent productivity tool. We are not affiliated with, endorsed by, or connected to the Election Commission of India, any government body, any political party, or any candidate.

11. Cookies and Tracking Technologies

The mobile application does not use cookies. We do not use third-party tracking technologies, advertising IDs, or behavioral analytics in the App.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. When we make material changes, we will:

• Update the "Last Updated" date at the top of this Policy
• Notify you through the App or via email (for significant changes)
• Obtain fresh consent if required by law

Your continued use of the App after changes are posted constitutes your acceptance of the updated Policy.
